These Terms & Conditions (“Terms”) govern your access to and use of FullFrameGear’s website, online store, and related services (collectively, the “Services”), including the purchase of pre-owned/used/second-hand film and cinema equipment, accessories, and related items (“Products”). References to “FullFrameGear”, “we”, “us” mean the store operator; “you” means any customer, visitor, or purchaser.
By browsing, placing an order, creating an account, making a payment, or otherwise using the Services, you agree to these Terms.
If there is a conflict between: (a) a signed agreement (e.g., B2B supply agreement, consignment agreement), (b) a written quote/invoice/policy, and (c) these Terms, the order of priority is: Signed Agreement → Quote/Invoice/Policy → These Terms, unless mandatory law requires otherwise.
1) Definitions
- “Products”: items listed for sale, typically pre-owned/used/second-hand film/cinema equipment and accessories.
- “Order”: your purchase request submitted through our checkout or accepted via invoice/quote.
- “Listing”: a product page, invoice line item, or written description of a Product and its condition/price.
- “Condition Grade”: our condition assessment (e.g., cosmetic/mechanical notes), which is an opinion based on inspection/testing at the time stated.
- “Device/Equipment Data”: serial numbers, model identifiers, firmware versions, shutter counts/hours (when available), and test notes.
- “Business Day”: a day other than weekends/declared holidays in our operating location.
- “Marketplace”: third-party platforms where Products may be listed/sold.
- “Force Majeure”: events beyond reasonable control (courier disruptions, outages, natural events, government actions, etc.).
2) Eligibility and account security
2.1 Eligibility. You represent you are legally capable of entering contracts and using the Services.
2.2 Account responsibility. If you create an account, you are responsible for safeguarding credentials and all activities under your account. Notify us promptly of suspected unauthorized use.
2.3 Accurate information. You must provide accurate billing/shipping/contact details. You are responsible for errors in delivery details you provide.
3) Products are pre-owned; condition and expectations (critical)
3.1 Used goods. Unless explicitly stated as new, Products are pre-owned/used/second-hand and may show wear, cosmetic marks, age-related degradation, and prior servicing history.
3.2 Condition descriptions are best-effort. Listings reflect our inspection/testing at the time of listing and are not a guarantee of future performance.
3.3 Testing scope. We test reasonably and proportionately, but we may not test every feature in every configuration (e.g., every codec, every lens compatibility edge-case, every port under all loads).
3.4 Consumables and cosmetic wear. Items such as batteries, grips, rubber, paint, screws, caps, adhesives, pads, cables, and media are subject to wear and may require replacement. Cosmetic condition does not necessarily indicate internal condition.
3.5 Firmware/software compatibility. Performance may depend on firmware versions, third-party accessories, media, power solutions, operating environments, and software compatibility. You are responsible for ensuring compatibility with your workflow.
3.6 Professional use risk. You acknowledge used equipment can fail. For mission-critical shoots, you should carry redundancy and test on receipt.
4) Pricing, taxes, and errors
4.1 Pricing. Prices are listed in [Currency]. Prices may change without notice before an Order is accepted.
4.2 Taxes/duties. Prices may exclude applicable taxes (GST/VAT), customs duties, import fees, brokerage fees, or similar charges. You are responsible for such charges unless we explicitly state otherwise.
4.3 Pricing/Listing errors. If a Product is incorrectly priced or materially misdescribed due to an error, we may cancel the Order and refund amounts paid, even after confirmation.
5) Order placement, acceptance, and cancellation
5.1 Order acceptance. Your Order is an offer to buy. We accept only when we: (a) ship the Product, (b) provide written acceptance, or (c) issue a tax invoice confirming acceptance.
5.2 Stock availability. Inventory is limited; Products may sell quickly. We may cancel Orders if stock is unavailable or oversold.
5.3 Order cancellation by you. If you request cancellation after payment but before shipping, cancellation may be allowed at our discretion and may incur payment processor fees and administrative charges to the maximum extent permitted by law.
5.4 Right to refuse. We may refuse/cancel Orders due to fraud risk, sanctions/export compliance, suspected misuse, address verification failure, or other lawful reasons.
6) Payments, fraud checks, and chargebacks
6.1 Payment methods. We accept payment methods shown at checkout/invoice.
6.2 Fraud prevention. We may perform risk checks (address validation, device signals, verification requests). We may place holds, request additional verification, or cancel Orders where risk is unacceptable.
6.3 No abusive chargebacks. You agree not to initiate chargebacks for legitimately placed Orders. Disputes must be raised under Section 16 first. If a chargeback is filed, you remain liable for amounts owed plus reasonable costs/fees incurred by us, to the maximum extent permitted by law.
7) Shipping, delivery, and risk of loss
7.1 Shipping timelines are estimates. Delivery dates are estimates and not guaranteed.
7.2 Risk of loss. Unless mandatory law states otherwise, risk of loss transfers to you upon delivery to the carrier (or upon pickup handover). Title transfers upon full payment and dispatch (or pickup), subject to mandatory consumer law.
7.3 Inspection on delivery. You must inspect packaging and Product immediately upon delivery. If the box is damaged or tampered, record evidence (photos/video), note it with the courier, and contact us within 24 hours.
7.4 Address accuracy. You are responsible for correct address details. Re-delivery, rerouting, return-to-origin, and storage fees caused by address errors are chargeable to you.
7.5 International orders. Cross-border shipments may be delayed by customs and subject to additional fees. We may require identity documentation where couriers/customs require it.
8) Returns, DOA, and refunds (used gear policy)
8.1 Return window (if offered). If we offer returns for a specific Product, the return window and conditions will be stated on the Listing or invoice. If not stated, returns are not guaranteed except where required by mandatory law.
8.2 DOA (Dead on Arrival). If a Product arrives non-functional in a manner inconsistent with the Listing, notify us within 48 hours of delivery with evidence (unboxing video strongly recommended, photos, test notes). We may require troubleshooting steps.
8.3 Return condition. Approved returns must be:
- returned with the same accessories included,
- packed securely,
- not disassembled or modified,
- not exposed to liquids/sand/impact after delivery,
- and with serial numbers matching our records.
8.4 Restocking fees. For buyer’s remorse returns (if allowed), restocking, shipping, packaging, and payment processing fees may be deducted, to the maximum extent permitted by law.
8.5 Refund timing. Refunds (if approved) are issued after inspection and may take time depending on payment method and bank processing.
8.6 Non-returnable items (typical). Unless mandatory law requires otherwise, the following are generally non-returnable:
- items sold “AS-IS” or “Final Sale”
- consumables (batteries, tapes, media, adhesives) once opened
- items damaged after delivery
- items with tampered serial numbers or removed security seals/marks
8.7 Partial refunds. If returned items are missing parts/accessories or show additional damage, we may offer partial refund or reject the return, consistent with law.
9) Warranty disclaimer; limited warranty (if any)
9.1 No implied warranties to the maximum extent permitted. Used goods are sold on a best-effort inspection basis. To the maximum extent permitted by law, we disclaim implied warranties including merchantability and fitness for a particular purpose.
9.2 Express limited warranty only if stated. Any warranty is only what is explicitly stated on the Listing or invoice (e.g., “7-day testing warranty”). If no warranty is stated, no warranty is provided except what mandatory law requires.
9.3 Warranty exclusions. Any stated warranty typically excludes:
- normal wear and consumables
- damage from misuse, improper power, liquids, sand, corrosion, impact
- third-party modifications/repairs
- firmware/software incompatibilities
- issues caused by accessories/media/power not recommended by manufacturer
- cosmetic issues consistent with grade/description
9.4 Exclusive remedy. If an express limited warranty applies and a valid claim is confirmed, the remedy is (at our option): repair, replacement (if available), store credit, or refund, subject to inspection.
10) Data on devices; media sanitation and liability
10.1 Residual data may exist. Cameras/recorders/monitors can contain residual user data. We may format/reset where feasible but do not guarantee complete erasure.
10.2 Buyer responsibility. You must perform your own secure wipe/reset and change any passwords upon receipt.
10.3 Seller responsibility (trade-in/consignment if offered). Sellers must remove data before handover. We are not responsible for data left on devices to the maximum extent permitted by law.
11) Serial numbers, authenticity checks, and stolen property
11.1 Serial tracking. We record serial numbers and identifying marks for inventory integrity, fraud prevention, returns validation, and lawful compliance.
11.2 Authenticity. We may perform reasonable authenticity checks, but we cannot guarantee manufacturer origin in all cases (especially for older accessories). Where a counterfeit risk is identified post-sale, we may request return and provide an appropriate remedy consistent with law.
11.3 Stolen property. If we reasonably suspect an item is stolen or linked to unlawful activity, we may hold, cancel, refuse sale, or cooperate with lawful authorities. You may be required to return the item and cooperate with investigation; remedies will follow applicable law.
12) Trade-ins, buyback, and consignment (if offered)
If FullFrameGear offers trade-ins/consignment, additional terms may apply and may be provided in a separate written agreement. At minimum:
12.1 Ownership warranty. You warrant you are the lawful owner and the item is not stolen, encumbered, or subject to third-party claims.
12.2 Condition disclosure. You must disclose known faults, prior repairs, water damage, impact damage, and missing parts.
12.3 Valuation is discretionary. Quotes are non-binding until physical inspection/testing. We may revise or reject.
12.4 Payouts. Payout method, fees, and timing will be stated in writing. We may delay payout for fraud checks, chargeback windows, or legal compliance where lawful.
12.5 Consignment risk. Consignment sale timelines are not guaranteed. Listing price may be adjusted as agreed. Unsold items may be returned subject to storage/handling fees if stated.
13) User content, reviews, and conduct
13.1 Reviews/UGC license. If you post reviews/photos/videos, you grant us a worldwide, non-exclusive, royalty-free license to use them for store operations and marketing, subject to law.
13.2 Prohibited conduct. You must not misuse the Services, attempt unauthorized access, scrape data, post unlawful content, or interfere with site operations.
14) Intellectual property
14.1 Our IP. The website, product photos (unless stated otherwise), logos, and content are owned by FullFrameGear or licensed to us. You may not copy or reuse without written permission.
14.2 Third-party marks. Manufacturer trademarks belong to their owners and are used for identification/compatibility only.
15) Privacy and data protection
Your use of the Services is also governed by the FullFrameGear Privacy Policy. For privacy requests contact: [email protected].
16) Disputes, support, and notice process
16.1 Support first. You must contact us at [email protected] with order details and evidence before escalating to payment disputes.
16.2 Notice. Legal notices must be sent to [email protected] and are deemed received when acknowledged or sent without bounce (subject to proof).
17) Limitation of liability
17.1 Liability cap. To the maximum extent permitted by law, our total liability arising from a Product/Order is capped at the amount you paid for that Product (excluding consequential losses).
17.2 No consequential damages. We are not liable for indirect, incidental, consequential, special, punitive damages, loss of profit, loss of data, business interruption, loss of production, or reputational loss.
17.3 Professional use disclaimer. We are not liable for shoot delays, missed opportunities, or production losses due to equipment failure, especially with used gear, except where mandatory law requires otherwise.
18) Indemnification
You agree to defend, indemnify, and hold harmless FullFrameGear and its owners, employees, contractors, and agents against claims and costs arising from your misuse of the Services, breach of these Terms, unlawful content, fraud, or third-party rights violations.
19) Force majeure
We are not liable for delays or failure to perform due to Force Majeure. If a Force Majeure event materially affects fulfillment, we may cancel and refund the affected Order amounts received (excluding non-recoverable third-party fees to the maximum extent permitted by law).
20) Compliance: export controls, sanctions, restricted uses
You agree not to purchase or use Products in violation of applicable export controls, sanctions, or laws. We may refuse or cancel Orders that create compliance risk. You are responsible for end-use and destination compliance.
21) Termination and suspension
We may suspend or terminate access to Services for suspected fraud, abuse, security risk, or legal compliance reasons.
22) Governing law and dispute resolution
Unless overridden by mandatory local law:
- Governing law: India and the State of Kerala
- Jurisdiction: Courts at Kochi, Kerala, India for interim relief and enforcement
- Arbitration (optional model): If you want the same structure as your other documents, insert:
“All disputes shall be finally resolved by confidential arbitration in Kochi, Kerala, India, by a sole arbitrator…”
(If you sell internationally, arbitration language should be aligned with your consumer law obligations in target regions.)
23) Miscellaneous
23.1 Entire agreement. These Terms plus any written order confirmation/invoice and any signed agreements form the entire agreement.
23.2 Severability. If any clause is invalid, the rest remains enforceable.
23.3 No waiver. Failure to enforce any right is not a waiver.
23.4 Assignment. You may not assign your rights without our written consent. We may assign to affiliates/successors.
23.5 Electronic acceptance. Click-acceptance, email approvals, and payments constitute acceptance.
